By accessing and using StPaulsReport.org and its services (the “Service”) you are agreeing to be legally bound by these Terms of Use.

1. GENERAL
The St Paul’s Anglican Church ,Symonds St, Auckland (“St Pauls”) may change these Terms of Use from time to time so be sure to check back periodically. Your use of StPaulsReport.org after any changes have been posted will constitute your agreement to the modified Terms of Use. You understand and acknowledge that St Pauls may discontinue or change StPaulsReport.org and/or the Service at any time, without notice, and that St Pauls do not warrant an uninterrupted and error free service. You also acknowledge and agree that St Pauls may discontinue or restrict your use of StPaulsReport.org for any reason without notice and without any liability to you. In addition, when using StPaulsReport.org, you shall be subject to any posted guidelines or rules applicable to the Service, which may be posted from time to time and which are hereby incorporated by reference into these Terms of Use.

2. COPYRIGHT
The content displayed on StPaulsReport.org, including the selection, arrangement, and design (“Content”) is the property of St Pauls (subject to the rights of its licensors and licensees under applicable agreements, understandings and arrangements) and is protected by copyright and other intellectual property laws as a collective work or compilation.

St Pauls  does not claim ownership of the Content you submit or make available for inclusion on StPaulsReport.org. The Content is the property of the author of such Content. You agree to grant St Pauls a perpetual, royalty-free and irrevocable right and license to use, reproduce, modify, adapt, publish, translate, distribute, transmit, publicly display, publicly perform, sublicense, create derivative works from, transfer, and sell such Content in any format now known or hereafter created, and to use your name and other identifying information you provide in connection with that Content. You also permit any visitor or member of StPaulsReport.org to use such Content for personal and non-commercial use.

If you believe in good faith that any Content infringes your copyright, you may send us a notice requesting that the material be removed though we cannot guarantee that any action will be taken as a result of your correspondence. Notices should be sent to enquiry@stpaulsreport.org

3. DISCLAIMER OF WARRANTIES AND LIABILITY
StPaulsReport.org includes facts, views and opinions of individuals and organizations and St Pauls  does not endorse these views and opinions nor does St Pauls  affirm the validity of any information presented as factual. St Pauls specifically disclaims any representations or warranties, express or implied, as to StPaulsReport.org and the Content and any information or goods that are available or advertised or sold through StPaulsReport.org including, without limitation, any representations or warranties of accuracy, completeness, timeliness, noninfringement, merchantability or fitness for a particular purpose. St Pauls will not be liable to you or anyone else for any loss or injury caused in whole or part by its negligence or contingencies beyond its control in procuring, compiling, interpreting, reporting or delivering StPaulsReport.org and the Content. In no event will St Pauls be liable to you or anyone else for any decision made or action taken by you in reliance on the Content. St Pauls shall not be liable to you or anyone else for any damages (including, without limitation, consequential, special, incidental, indirect, or similar damages), other than direct damages, even if advised of the possibility of such damages. Because some countries or jurisdictions do not allow the exclusion or limitation of liability for damages or the exclusion of certain types of warranties, parts or all of the above limitation may not apply to you.

While St Pauls makes reasonable effort to ensure confidentiality, it may be possible for third parties to acquire information about you through computer hacking or otherwise.

4. LINKS TO THIRD PARTY SITES
StPaulsReport.org may contain hyperlinks to web sites operated by persons other than St Pauls  . You agree not to hold St Pauls responsible for the content or operation of such web sites. A hyperlink from StPaulsReport.org to another web site does not imply or mean that St Pauls endorses the content on that web site or the operator or operations of that site. You are solely responsible for determining the extent to which you may use any content at any other web sites to which you might link from StPaulsReport.org.

StPaulsReport.org contains advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on StPaulsReport.org complies with international and national law. St Pauls will not be responsible for any errorr inaccuracy in advertising or sponsorhip material.

StPaulsReport.org will not be party to, or in any way repsonsible for, any transaction concerning goods or services available from Third Party sites that you have linked to from StPaulsReport.org or otherwise been introduced to. If you purchase products or servics from a Third Party site your contract for such goods or services will be with the Third Party and not with St Pauls. 

5. ADDITIONAL LEGAL TERMS
These Terms of Use, your rights and obligations, and all actions contemplated by these Terms of Use will be governed by the laws of New Zealand, as if these Terms of Use were a contract wholly entered into and wholly performed within New Zealand. If any provision in these Terms of Use is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect, and the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision. These Terms of Use, including the Submission Guidelines and the Privacy Policy, are the entire and final agreement regarding StPaulsReport.org and its Content, and supersede any prior or contemporaneous communications between St Pauls and you regarding StPaulsReport.org and its Content.

6. USER OBLIGATIONS
(a) In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of New Zealand or other applicable jurisdiction. St Pauls cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 6. You agree to comply with all local rules regarding online conduct and acceptable Content, including all applicable laws regarding the transmission of technical data exported from New Zealand or the country in which you reside.

St Pauls reserves the right to remove any Content or not publish any Content submissions without prior notice.

(b) You agree not to use StPaulsReport.org or the Service to:
1. upload, post, email, transmit or otherwise make available (“Post”) any Content:
(a) that is unlawful, harmful, threatening, abusive, harassing, tortious, pornographic, defamatory, vulgar, obscene, libelous, false or inaccurate, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
(b) that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); or
(c) that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;

2. harm minors in any way;

3. impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

4. Post any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;

5. Post any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

6. Post or otherwise publish any content unrelated to the discussion forum within which it is posted;

7. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

8. violate any applicable local, state, national or international law, intentionally or unintentionally;

9. "stalk" or otherwise harass another; and/or

10. collect or store personal data about other users.

(c) You agree to be fully responsible for your own Content. StPaulsReport.org acts as a venue for you to Post your Content. While St Pauls has the right to refuse to post or remove, edit or abridge any Content for any reason, it is otherwise not involved in the writing or decisions as to the Content of its users. As a result, St Pauls has no control over the quality, accuracy or legality of the Content on StPaulsReport.org. All Content posted on StPaulsReport.org is the sole responsibility of the person from whom such Content originated. Because StPaulsReport.org is a venue, in the event that you have a dispute with a user of StPaulsReport.org and its Service, you release St Pauls and its officers, members, employees, and associates from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

(d) You agree to indemnify and hold St Pauls and its officers, members, employees, and associates harmless from any claims, damages, losses or costs (including reasonable lawyers's fees) that arise out of any of your Content, including, without limitation, any Content posted or otherwise provided by you that infringes any copyright, trademark, intellectual property right of any person or defames any person or violates any person's rights of publicity or privacy, or otherwise violates these Terms of Use.

(e) if you are a copyright owner and believe that Content infringes upon your copyright please submit a notice to us with the following: (1) an electronic or physical signature of the Copyright owner or the person authorized to act on behalf of the owner of the copyright; (2) a description of the copyrighted work that you claim has been infringed; (3) the URL of the location containing the material that you claim is infringing; (4) your address, telephone number, and email address; (5) a statement by you that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law; (6) a statement by you that the above information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf.

(f) Just as StPaulsReport.org excerpts materials from other sources in order to support its op-eds and various other commentaries and writings contained on the website, we respect the right of others to make “fair use” of the materials contained on StPaulsReport.org; accordingly, you may from time to time excerpt and use materials set forth on this site, provided, that you must give the original author credit and such use must be for a non-commercial purpose only and not, for example, for re-sale.  .

7. JURISDICTION

The terms and condition shall be governed by and construed in accordance with New Zealand Law.

If any provision of these terms and conditions is found to be invalid by any New Zealand court, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions which shall remain in full force and effect. 

8. CHANGES TO TERMS AND CONDITIONS
These terms and conditions were published on 11 May 2009 and replace with immediate effect any prior terms and conditions.
